Terms and Conditions

  1. The Amsterdam City Swim is an initiative and program of the Amsterdam City Swim Foundation.
  2. The goal of the Amsterdam City Swim is to raise awareness and money in order to the fight the disease ALS for the ALS Foundation by organizing a unique swimming experience of 2 KM in the Amsterdam Canals on September 3th, 2017.
  3. The Amsterdam City Swim occurs with the required permit issued by the City of Amsterdam.
  4. Even though the Amsterdam City Swim Foundation is responsible for the content of the Amsterdam City Swim program and content on the website www.amsterdamcityswim.nl, no rights can be derived.
  5. The total proceeds of the Amsterdam City Swim, which are registration fees, donation money and sponsor money, minus the costs of the payments and costs of the organization of the event, will benefit the ALS Foundation. The Amsterdam City Swim has the ANBI Status. The RSIN of the Amsterdam City Swim I 851325312.
  6. Being a member of the board of the NACS Foundation is an unpaid position. The board members receive an annual expense allowance of €1.250 per person, the secretary will receive € 1.750. Volunteers who are present during the event will receive a travel allowance.
  7. The total donation counter on the homepage of www.amsterdamcityswim.nl and on the personal pages of the participants and volunteers shows the net amount of donations, thus the donation proceeds minus transaction costs. On the profile pages of all participants we will show the gross amount. The transaction costs are to and € 0.40 cents per. The participant is free to choose at registration whether or not to pay for the transaction costs.
  8. The treasurer of the Amsterdam City Swim Foundation oversees the revenue stream and costs, using the project administration that has been opened specifically for this event.
  9. All participants, along with a declaration at the registration process, will be asked to agree upon the processing of their personal data to the extent necessary for the organization of the event. All personal information will be treated confidentially by the Amsterdam City Swim Foundation in accordance with the Data Protection Act. The people that have agreed to these terms on the compulsory fields to be approached by third parties can be approached once by the partners/sponsors of the Amsterdam City Swim for marketing purposes.
  10. The Amsterdam City Swim Foundation reserves the right to make changes to the Amsterdam City Swim of 2017 program at any time.
  11.  The Amsterdam City Swim reserves the right to terminate the Amsterdam City Swim program without reason after September 3, 2017.
  12. The Amsterdam City Swim Foundation reserves the right to cancel or make changes to the program of the event to an alternative location or starting time due to bad weather or unforeseeable circumstances, bad water quality or a temperature lower than 15 degrees Celsius. Registration money will only be restituted by a complete annulment, after deduction of incurred out-of-pocket costs incurred by the organization and cost of the payment system. Donation funds will benefit the foundation directly and will not be returned. This is also applicable for the Amsterdam City Swim for Kids and the Amsterdam Late Night Swim.
  13. The Amsterdam City Swim Foundation will publically announce at the end of the event how much donation money has been raised and reports on the projects that this donation money is spent on along with the progress of these projects. Up until September 30th, 2017, all participants will get the occasion to meet their obligation with respect to the retrieval of the donation money.

Exclusion from liability

Participating

  1. Each participant will be forced to sign a disclaimer at registration on September 3rd where he/she will agree upon the participation at his/her own risk. In this disclaimer, special attention will be paid to risks involved with water quality and the risks of collisions. This disclaimer will be made available electronically once the start documents are sent via email.
  2. There is a maximum of 1500 individual swimmers and maximum of 250 business teams that can participate in the event unless the board of the foundation states otherwise.
  3. Each individual swimmer (with a minimum age of 15 years, not pregnant and healthy- see point 5 below) that registers, pays €110 registration fees (VAT incl.) and strives to raise a minimum of €400 sponsor money via his/her personal profile for the ALS Foundation. A participant (+mentor) of the Amsterdam City Swim for Kids pays €65 (VAT incl.) and strives to raise a minimum of €100 sponsor money.
  4. Each business team pays €1.100 registration fees (VAT not included) and aims to raise a minimum of €400 donation money per participant, thus €1.600 per team. Business teams are able to pay all in one go for the amount of €3.100.
  5. A participant is a minimum of 15 years of age, not pregnant and does not have any health issues. Each participant is asked prior to the start of the event to sign a health statement. A participant of the Amsterdam City Swim for Kids has a age between 10 and 14 years old. The mentor of the kid is a minimum of 18 years of age. Participants of the Amsterdam City Swim are also asked to sign a health statement.
  6. A participant is required to have on him/herself a valid ID on the day of the event (September 3rd, 2017). In addition with the registration confirmation, this is the admission to the starting area.
  7. The registration fees are directly withdrawn during registration by the payment system on www.amsterdamcityswim.nl. Individual participants and participants of the Amsterdam City Swim for Kids are only able to pay by Ideal. Foreign payments or business team payments can be done by invoice in consultation with the organization.
  8. In case an individual participant is unable to attend the event on September 3rd 2017 due to family circumstances or health problems, then with proof of a legal statement, the registration money is returned until 1 month before the event. In this case, the organization is contacted by the participant. Raised sponsor money cannot be returned.  From the 3rd of august 2017 it’s not possible to cancel participation and return the registration fees.
  9. The donation money is donated directly via the personal profile of the participant. The donation money has to be transferred by September 3rd 2017.
  10. The donation money is linked to the participant and is transferred directly to the donation account of the Amsterdam City Swim (NL.59.RABO.01.46.25.24.89)
  11. Participants that haven’t done their best effort to raise the minimum €400 required will be excluded from the next edition of the Amsterdam City Swim and will not be given the opportunity to take part in the pre-registration.
  12. Participation in the Amsterdam City Swim, the Amsterdam City Swim for Kids or the Amsterdam Late Night City Swim and/or organized trainings prior to the events, is entirely at own risk of the participants. The organization is at no point and no matter what liable for any occurred injuries or damage with further consequences to the visit or participation of the Amsterdam City Swim on September 3rd, 2017 or side events that take place prior to the swim.
  13. Starting proofs of participants are not to be taken by third parties for promotional or commercial purposes.

Additional conditions for participation by business teams.

  1. A business team consists of a maximum of 4 participants that are 18 years or older that are employed to the relevant company.
  2. A business team pays €1.100 excluding VAT registration money. This payment shall be made via de website www.amsterdamcityswim.nl through the payment system or by invoice.
  3. In case the payment is not received within 14 days of the registration (or in the case of an invoice after receiving the invoice), then the entry lapses.
  4. A business team needs to comply to raising a minimum of €400 donation money per person, which can be donated via the business team’s profile. All donation money is to be received by the September 3rd, 2017.
  5. Business teams that do not meet the minimum of €400 donation money per participant will be excluded from participation during the next edition.
  6. Business teams that wish to transfer the entire donation money in one go can transfer €3.100 directly to the donationaccount citing Business Team *name* (NL.59.RABO.01.46.25.24.89) or can contact the organization via info@amsterdamcityswim.nl.
  7. Business teams should not be used by third parties for promotional or commercial purposes.
  8. Per company, a maximum of 10 business teams are allowed to be registered. In case a company wishes to override this maximum, contact should be sought with the organization.

Awards of participants

Each participant that takes part in the Amsterdam City Swim, the Amsterdam City Swim for Kids or the Amsterdam Late Night City Swim will have a time registration done via a microchip system. After this event, an award ceremony will take place for the fastest man/woman in the match wave. Even though there may be faster swimmers in the normal waves, these will not count for the award ceremony.

Side event: Amsterdam City Swim for Kids

  1. On September 3rd, 2017, a side event is organized for kids between 10 and 14 year old.
  2. The registration fee is €65,00 for a kid and mentor. The kid strives to raise a minimum of €100 of sponsor money via his/her personal page for the Dutch ALS Foundation.
  3. Each mentor will be forced to sign a disclaimer at registration on September 3rd where he/she will agree upon the participation at his/her own risk and of his/her child. In this disclaimer, special attention will be paid to risks involved with water quality and the risks of collisions. This disclaimer will be made available electronically once the start documents are sent via email.
  4. A maximum of 300 kids with mentors (total of 600) are allowed to participate in the Amsterdam City Swim for Kids, unless the organization of the Foundation decides otherwise.
  5. A participant is required to have on him/herself a valid ID on the day of the event (September 3rd, 2017). In addition with the registration confirmation, this is the admission to the starting area at the Hermitage next to the Amstel.
  6. The registration fees are directly withdrawn during registration by the payment system on www.amsterdamcityswim.nl. Participants are able to pay by Ideal only.
  7. In case an individual participant is unable to attend the event on September 3rd 2017 due to family circumstances or health problems, then with proof of a legal statement, the registration money is returned until 1 month before the event. In this case, the organization is contacted by the participant. Raised sponsor money cannot be returned.  From the 3rd of august 2017 it’s not possible to cancel participation and return the registration fees.

  11. Participants of the Kids event that haven’t done their best effort to raise the minimum €100 required will be excluded from the next edition of the Amsterdam City Swim and will not be given the opportunity to take part in the pre-registration.
  12. Participation in the Amsterdam City Swim for is entirely at own risk of the participants. The organization is at no point and no matter what liable for any occurred injuries or damage with further consequences to the visit or participation of the Amsterdam City Swim for Kids on September 3rd, 2017 or side events that take place prior to the swim.
  13. Starting proofs of participants are not to be taken by third parties for promotional or commercial purposes.
  14. The organization of the Amsterdam City Swim for Kids can only take place when the City of Amsterdam has given the required licenses.
  15. The Amsterdam City Swim Foundation reserves the right to cancel or make changes to the program of the event to an alternative location or starting time due to bad weather or unforeseeable circumstances, bad water quality or a temperature lower than 15 degrees Celsius. Registration money will only be restituted by a complete annulment, after deduction of incurred out-of-pocket costs incurred by the organization and cost of the payment system. Donation funds will benefit the foundation directly and will not be returned.
